First Aid Legal Requirements.
The Health and Safety (First Aid) Regulations 1981, state that employers are under a duty to make 'adequate and
appropriate' provision for first aid. Employers should bear in mind that these regulations do go as far as to state
exactly how many First Aiders or First Aid Appointed Persons are required, they merely give guidelines.
What is asked is that all employers assess their first aid needs and make provision for appropriate cover according
to the circumstances of each workplace.
Any assessment should take into account the likely hazards in your business, the size and distribution of the
organization, your accident history and how close you are to emergency medical services. The needs of disabled
and young workers also need to be accounted for.
Any person selected to attend a First Aid at Work (FAW) course that will be subsequently required to render first
aid must be 'suitable.' Suitable in this sense means that they have undergone a period of training and have the
qualifications which are approved by the HSE.
First Aiders need certain characteristics; they need to be reliable and have the ability to remain calm in an
emergency situation. They should be good communicators and be able to cope with the physical and mental demands
that may be present when dealing with an emergency. They should be easily contacted and have the ability to leave
their workstation immediately and safely. Finally they should be able to cope with and intensive period of study
required of the FAW course.
Employers should inform all employees of the arrangements in place for first aid, which will include the location
of the equipment, facilities and who are trained personnel.
There are 2 exceptions.
1. Where the suitable person is absent in temporary and exceptional circumstances then it will be sufficient for
the employers to appoint a person (Appointed Person (AP)) to take charge of any situations relating to injured
or ill employees.
2. Where you have considered the nature of your undertaking, the number of employees at work and the location of
the workplace (undertook a Risk Assessment) and have decided that it would be adequate and appropriate to simply
put someone in charge of dealing with situations relating to injured or ill employees. At minimum these employees
need to be AP trained.
Employers should always consider that should there be an accident where there was insufficient medical cover to
deal with the situation then the HSE may choose to investigate it and question why this was the case. Best practice
would therefore ensure that adequate cover is provided at all times including when persons are absent, which
indicates that more than one FAW should be available for each shift or workplace at all times.
It is also best practice for employers to compliment the number of FAW's available with a number of AP trained
personnel. FAW is a 4 day Course which is valid for 3 years, this requires Refresher Training of 2 days before
the 3 year point runs out. AP consists of 1 days training which also remains valid for 3 years.
